These Terms & Conditions (“Terms”) are a legal agreement between you (“you”, “user”) and KAPBALL (“we”, “us”, “our”) governing your access to and use of the Site, services or products provided by us (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Use of the Service

2. Products, Services & Payments

If you purchase any products or services through the Site (including digital products, memberships, coaching, etc.), you agree to pay all applicable fees.
All fees are non-refundable unless otherwise specified. We may change the pricing or terms of the services at our discretion; any changes will be posted on the Site.
Access to digital products may be subject to certain restrictions or access limitations, as described at time of purchase.

3. Intellectual Property

The Service and all content (including text, graphics, logos, images, videos, software) are owned by or licensed to KAPBALL and are protected by intellectual property laws.
You may not reproduce, distribute, modify, display or create derivative works of the content except as expressly permitted in writing by us.
“KAPBALL” and related marks are trademarks of our company.

4. Disclaimers & Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
We do not guarantee that the Service will be uninterrupted, error-free, secure or free from viruses or other harmful components.
To the maximum extent permitted by applicable law, we exclude all liability for any indirect, incidental, special or consequential damages arising out of or in connection with your use of the Service. Our total liability to you for all claims will not exceed the amount you paid (if any) to us in the prior 12 months.
Some jurisdictions do not allow exclusion or limitation of certain warranties or liabilities; in such cases, our liability shall be limited to the fullest extent permitted by law.

You agree to defend, indemnify and hold harmless KAPBALL and its affiliates, officers, directors, employees and agents from and against any claims, damages, obligations, losses, liabilities, costs or debt arising from (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of another.

6. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Connecticut, without regard to its conflict of laws rules.
You and we agree to submit to the exclusive jurisdiction of the courts located in Middlesex County/Middletown, CT for any dispute arising out of or relating to these Terms or the Service.

7. Changes to Terms

We may revise these Terms at any time by posting an updated version on the Site. The “Effective Date” at the top will mark when the changes take effect. Your continued use of the Service after such date constitutes your acceptance of the revised Terms.

8. Severability & Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. A waiver of any right or provision under these Terms will only be effective if made in writing and signed by us.

9. Entire Agreement

These Terms, together with any policies or additional terms posted by us on the Site (such as the Privacy Policy), constitute the entire agreement between you and KAPBALL regarding the Service, superseding any prior agreements.
